ANAYASA MAHKEMESİ’NİN 2024 TARİHLİ GEÇİCİ KORUMA STATÜSÜNDEKİ YABANCILARIN ADLİ YARDIM ALMA HAKKINA İLİŞKİN KARARI HAKKINDA BİR DEĞERLENDİRME

Abstract
Türkiye Cumhuriyeti Anayasası herkesin adil yargılanma hakkını güvence altına alırken, yabancılar için bazı kısıtlamalar öngörmektedir. Özellikle, yabancıların adli yardıma başvurabilmesi için, kendi ülkelerinin Türkiye ile mütekabiliyet anlaşması yapması gerekmektedir. Bu durum, uluslararası koruma statüsündeki yabancılarda sorun yaratmazken, geçici koruma statüsündeki yabancılar için ciddi sıkıntılara yol açmaktadır. Anayasa Mahkemesi, bu statüdeki yabancılara, adil yargılanma hakkı kapsamında mahkemeye erişim ve adli yardım talebinin kabul edilmesi gerektiğine karar vermiştir. Çalışmamızda, geçici koruma kapsamındaki yabancıların mahkemeye erişim ve adli yardım hakları, Anayasa Mahkemesi’nin 2024 kararına dayalı olarak tartışılacak ve mevzuat değişikliği önerilecektir.

Abstract
While the Constitution of the Republic of Türkiye guarantees everyone's right to a fair trial, it also provides some restrictions for foreigners. In particular, for foreigners to apply for legal aid, their home country must conclude a reciprocity agreement with Türkiye. While this does not cause problems for foreigners with international protection status, it causes serious problems for foreigners with temporary protection status. The Constitutional Court has ruled that foreigners with this status should be granted access to court and legal aid within the scope of the right to a fair trial. In our study, the rights of foreigners under temporary protection to access court and legal aid will be discussed based on the Constitutional Court's 2024 judgment, and, legislative amendments will be proposed.
