n the EU process, which started with Turkey's full membership goals to the EU, 60 years have passed since the 1963 Ankara Agreement, 53 years since the 1970 Additional Protocol, and 28 years since the 1995 Customs Union.
The 1963 Ankara Agreement and the Association Agreement with the EEC, followed by the Additional Protocol containing the rules on the Customs Union, were signed in 1970. On 6 October 2004, the Commission recommended that Turkey's accession negotiations be initiated.
The condition of Article 2 in the Article 49 of the EU Treaty is an important criterion that may result in the suspension of membership rights not only for the candidate countries but also within the member states when deemed necessary.
According to Article 28 of the Ankara Agreement, "When the operation of the Agreement shows that Turkey can assume all the obligations arising from the agreement establishing the Community, the Contracting Parties examine the possibility of Turkey's joining the Community." Although this article is interpreted as goodwill by some circles, this provision imposes obligations on the parties, according to Arat. It is an obligation to take the necessary measures to reach this result when it comes to it, in a way that does not prevent it, it falls into the category of a strong partnership beyond the customs union. Another point is that there are no special provisions regarding the termination of the Agreement in the General and Final Provisions of Article 28, which is indicated by the Law of Nations. It is interpreted as that it cannot be terminated except for general reasons, besides the similarity of the Treaty of Rome with its structure that foresees an irreversible integration, its termination will be with an accession agreement.
In this study, the Customs Union Update in relations with the EU, establishing an FTA like the United Kingdom model, continuing, discussions on different membership models with the EU are intensified today, within the framework of EU Treaty article 49 and Ankara Agreement article 28, Chapters 23, 29, 30 1998-2022. Includes progress review over the years. The EU Commission monitors Turkey's status in terms of political, economic, and harmonization criteria with the Progress Report and the Enlargement Strategy Report. The annual evaluation of the sections related to the work of the reports available on the official website of the European Union Commission and the official website of the Ministry of Foreign Affairs of the EU Presidency have been studied together with the important issues that shaped that year, the reports are very comprehensive and detailed, but our current study is limited, so only relevant to the important issue details were transferred to the study.
