Abstract
Küreselleşme ve yoğunlaşan sınır ötesi nüfus hareketleri, devletlerin cezai konularda adli iş birliği ihtiyacını artırmaktadır. Ceza infaz hukukunun temel amaçlarından biri olan hükümlünün topluma yeniden kazandırılması amacı hükümlü nakli kurumunun gelişimine zemin hazırlamıştır. Uluslararası hükümlü nakli, yabancı ülkede mahkum olan kişilerin cezalarını kendi ülkelerinde veya güçlü bağlarının bulunduğu devlette çekmelerine imkan tanıyarak hem aile hayatına saygı hakkına ve sosyal uyuma hizmet etmekte hem de devletlerarası yardımlaşmayı sağlamaktadır. Bu çalışmada, hükümlü naklinin genel esasları ve diğer adli iş birliği kurumlarından farkları ele alınarak hükümlünün yurt dışından Türkiye’ye nakil şartları, usulü ve nakil hususunda takdir yetkisinin ölçütleri yargı kararları çerçevesinde değerlendirilmektedir.

Abstract
Globalization and intensifying cross-border population movements have increased the necessity for judicial cooperation among states in criminal matters. The rehabilitation of sentenced persons—one of the primary objectives of penal execution law—has laid the groundwork for the development of the institution of the transfer of sentenced persons. International transfer of sentenced persons allows individuals convicted in a foreign country to serve their sentences in their home country or in a state with which they have strong ties, thereby serving both the right to respect for family life and social integration, as well as fostering international mutual assistance. In this study, the general principles of the transfer of sentenced persons and its distinctions from other judicial cooperation mechanisms are addressed, and the conditions, procedures, and criteria for discretionary power regarding the transfer of sentenced persons from abroad to Türkiye are evaluated within the framework of judicial decisions.
