TÜRK DENİZ İŞ HUKUKUNDA GEMİ ADAMI İAŞE BEDELİ

Abstract
Deniz İş Kanunu Deniz İş Kanunu’na tabi çalışan gemilerde çalışan gemi adamları için iaşe servisi kurulmasını zorunlu kılmaktadır. Bununla birlikte, kimi durumlarda ayni yardım yerine nakdi ödeme de yapılabilmektedir. Gemi adamına yapılan söz konusu nakdi ödeme iaşe bedeli olarak adlandırılmaktadır. Gemi adamının hangi durumlarda iaşe bedeline hak kazanacağı yasada düzenlenmiş; ayrıntılara ise yönetmelikte yer verilmiştir. İaşe bedeli tutarı her yıl İaşe Bedeli Tespit Kurulu tarafından belirlenmektedir. Kurul tarafından belirlenen iaşe bedeli tutarı hizmet sözleşmesiyle veya toplu iş sözleşmesiyle artırılabilir. İaşe bedeli ödenmeyen gemi adamı hizmet sözleşmesini haklı nedenle derhal feshedebilir. Gemi adamının iaşe bedeli hakkı yasadan doğmakta olup, sözleşmeden kaynaklanan yemek yardımı veya ücretinden farklıdır.

Abstract
The Maritime Labor Code stipulates the establishment of a food service for seamen working on vessels subject to the Maritime Labor Code. However, in some cases, cash payments may be made instead of in-kind assistance. This cash payment to the seaman is called a food allowance. The conditions under which a seaman is entitled to a food allowance are regulated by Code; details are provided in the regulation. The amount of the food allowance is determined annually by the Food Allowance Determination Board. The amount of the food allowance determined by the Board may be increased by the employment contract or collective bargaining agreement. A seaman who does not receive a food allowance may immediately terminate his employment contract for just cause. The seamans’ right to food allowance stems from the legislation and is different from meal allowances or wages arising from contracts.
