Abstract

Dijitalleşmenin yaygınlaşması ile idarelerin de karar alma süreçlerinde algoritmik sistemlerden faydalanmaya başlaması ve hatta bu sürecin neredeyse devredilmesi,  idare hukuku açısından yeni bir hukuki uyuşmazlık alanı doğurmuştur. İdari işlemlerde idari usul güvencelerinden biri olan gerekçe ilkesi, algoritmaların teknik karmaşıklığı ve "kara kutu" (black box) sorunsalı karşısında geleneksel anlamını kaybetme eğilimi göstermektedir. Bu çalışmada, özellikle makine öğrenmesi tabanlı sistemlerle tesis edilen idari işlemlerde, idari işlemin sebebinin ve gerekçesinin hukuki geçerliliği ve bu hususun bireyin savunma hakkı üzerindeki etkileri incelenmektedir. Çalışmanın temel amacı, algoritmik sistemlerin hızı ve verimliliğinin, idarenin "açıklanabilir" ve "anlaşılabilir" gerekçe sunma yükümlülüğünün önüne geçemeyeceğidir. Bu kapsamda, Avrupa Birliği'nin yeni regülasyonu Yapay Zeka Yasası (AI Act) uyarınca ve güncel veri koruma hukuku içtihatları ışığında, gerekçe ilkesinin yeniden yorumlanması gerekliliği tartışılmaktadır. Son bölümde ise, tam otomatikleştirilmiş işlemlerin yargısal denetiminde karşılaşılan zorluklar ele alınarak çözüm önerileri sunulmaktadır.

Abstract

With the widespread adoption of digitalization, the fact that administrations have begun to utilize and even delegate algorithmic systems in their decision-making processes has created a new field of legal dispute in terms of classical administrative law. The principle of justification (duty to give reasons), which is one of the administrative procedural safeguards, tends to lose its traditional meaning in the face of the technical complexity of algorithms and the "black box" problem. This study examines the legal validity of the "grounds" and "justification" of administrative acts, particularly those established through machine learning-based systems, as well as the implications of this matter for individual's right of defense.

The central thesis of the study is that the speed and efficiency of algorithmic systems cannot override the administration's obligation to provide an "explainable" and "understandable" justification. In this context, the necessity of reinterpreting the principle of justification is discussed in light of the European Union Artificial Intelligence Act (AI Act) and current data protection law jurisprudence. The final section addresses the challenges encountered in the judicial review of fully automated decision making processes and offers solutions.
