ARİSTOTELES’İN ADALET ANLAYIŞI TEMELİNDE TÜRKİYE’DE VATAN HİZMETİNİN DEĞERLENDİRİLMESİ

Abstract
Eski Yunan Kent Devletleri, devlet teorisi alanında araştırma yapanların güncel bir meseleye çözüm aradıklarında inceleyebildikleri ve çözüm yoluna ilişkin önemli veriler bulabildikleri örneklerden birisidir. Kent devletleri içinde en çok örnek alınan ve araştırılan Atina Kent Devleti’dir. Atina’nın toplum yapısı, vatandaşlık şekli, demokrasiyi uygulama biçimi, hak ve özgürlüklere yaklaşımı gibi konular; tarihsel gelişmelerin seyrini takip edebilmek ve yorumlayabilmek için kullanılmaktadır. Bu kavramların Atina Kent Devleti’nde ne anlama geldiğine odaklanan ve bulgular ile günümüz problemlerine çözüm arayanlar bakımından öne çıkan filozoflardan biri ise Aristoteles’tir.
Aristoteles; Kent Devleti’nin sorunlarını ve gelişimini özellikle sosyolojik açıdan tahlil eden, elde ettiği tespitleri adalet temelinde yorumlayan bir filozoftur. O’nun içinde bulunduğu durumu adalet temelinde yorumlama kaygısı, Atina Kent Devleti’nin bu sayede sürekli olabileceğine ve toplumun adalet etrafında örgütlenebileceğine inanmasındandır. Aristoteles’in adalet kaygısı; kavramı dağıtıcı adalet, denkleştirici adalet gibi türlerle tanımlamayı gerektirmiş ve bu türler günümüzün birey-devlet ilişkisine sosyal devlet, liberal devlet gibi çözümlemeler sunmuştur.
Bu makale; anayasasında kendisini sosyal devlet olarak tanımlayan Türkiye’de, yine anayasal olarak her yurttaş için hak ve yükümlülük şeklinde tanımlanan vatan hizmetinin yerine getirilişini, Aristoteles’in adalet anlayışı temelinde değerlendirmektedir. Makalede vatan hizmetine dair cevaplanmaya çalışılan temel soru; bireyler açısından nasıl yerine getirilmesi gerektiği tartışmasından ziyade, toplumun tümünü kapsaması ve adalet türleri içinde benimsenebilir zemine oturtulmasıdır. Dolayısıyla, makalede adalet kavramının Aristoteles tarafından nasıl yorumlandığı, vatan hizmetinin Türkiye’de yerine getiriliş şekli ve mevcut düzenlemelerin Aristoteles’in adalet anlayışı ile uyuşan ya da çelişen yönleri ele alınmaktadır.

Abstract
The ancient Greek city-states are one of the examples that researchers in the field of state theory can examine when seeking solutions to current issues and find important data related to possible solutions. The most frequently cited and researched example among the city-states is the Athenian city-state. Topics such as the social structure of Athens, the form of citizenship, the implementation of democracy, and the approach to rights and freedoms are used to follow and interpret the course of historical developments. One of the philosophers who focused on what these concepts meant in the Athenian city-state and stood out in terms of finding solutions to today's problems with his findings was Aristotle.
Aristotle is a philosopher who analyzes the problems and development of the city-state, particularly from a sociological perspective, and interprets his findings on the basis of justice. His concern with interpreting the situation on the basis of justice stems from his belief that the Athenian city-state can thus be sustained and that society can be organized around justice. Aristotle's concern for justice required him to define the concept in terms of distributive justice and corrective justice, and these types have provided solutions to today's individual-state relationship in the form of the social state and the liberal state.
This article evaluates the fulfillment of national service, which is defined in the constitution as a right and obligation for every citizen in Turkey, which defines itself as a social state in its constitution, based on Aristotle's understanding of justice. The fundamental question addressed in the article regarding national service is not so much how it should be fulfilled from the perspective of individuals, but rather how it should encompass the entire society and be grounded in a framework that is compatible with the types of justice. Therefore, the article discusses how Aristotle interpreted the concept of justice, how national service is carried out in Turkey, and the aspects of current regulations that are consistent with or contradict Aristotle's understanding of justice.
