Avrupa Birliği'nin Değişen Sağlık Yaklaşımı: Avrupa Sağlık Veri Alanı (EHDS)

Abstract
Avrupa Sağlık Veri Alanı (EHDS), Avrupa Birliği’nde sağlık verileri için tek alan oluşturmayı hedefleyen bir çerçeve sunmaktadır. Covid-19 Pandemisi ile bilimsel çalışmalarda sağlık verilerinin kullanılması gerekliliği karşısında Avrupa Veri Koruma Tüzüğü’nün (GDPR) kısıtlayıcı olduğu düşünülen kuralları, EHDS’nin hayata geçirilmesinde rol oynamıştır. Esasen Avrupa Birliği’nde, Avrupa Veri Stratejisi kapsamında farklı sektörlerde veri alanları oluşturulması bir süredir planlanmaktadır. EHDS, Avrupa Veri Stratejisi kapsamında hayata geçirilen ilk veri alanı olması yönüyle önemlidir. EHDS, bireyler açısından sağlık verilerine erişimi kolaylaştırmayı ve verilerde değişiklik yapılabilmesini hedeflemektedir. Bununla birlikte öne çıkan bir diğer hedefi, verilerin ikincil kullanımını kolaylaştırarak sağlık alanında araştırma ve yenilikleri desteklemektir. Bu hedefler doğrultusunda, Birlik genelinde tek tip bir yasal çerçeve oluşturularak hem ulusal hem bölgesel birçok yenilik öngörülmüştür. Bu çalışmada Avrupa Birliği'nde sağlık verilerinin korunmasına yönelik hakim yaklaşıma EHDS’nin etkisi, literatür taraması yöntemiyle irdelenmiştir. EHDS ile öngörülen yeniliklerin GDPR ile uyum içerisinde olmadığı ve sağlık verilerinin korunmasına ilişkin endişeleri beraberinde getirdiği görülmektedir.

Abstract
The European Health Data Space (EHDS) provides a framework that aims to create a single market for health data in the European Union.The rules of the General Data Protection Regulation (GDPR), which were considered restrictive in the face of the need to use health data in scientific studies due to the Covid-19 Pandemic, played a role in the implementation of the EHDS. However, in the European Union, the creation of data areas in different sectors within the scope of the European Data Strategy has been planned for a while. The EHDS is important as it is the first digital single market for data implemented within the scope of the European Data Strategy. The EHDS aims to facilitate access to health data for individuals and to enable changes to the data. However, another prominent goal is to support research and innovation in the field of health by facilitating the secondary use of data. In line with these goals, a uniform legal framework has been established throughout the Union and many national and regional innovations have been envisaged. In this study, the impact of the EHDS on the dominant approach to the protection of health data in the European Union has been examined through a literature review method. It is seen that the innovations envisaged by the EHDS are not in line with the GDPR and raise concerns regarding the protection of health data.
