Abstract
Öz: Roma Hukuku’nun günümüz hukuk sistemlerine etkisini yadsınamaz. Mülkiyet ve teminat kavramları da bu etkiden münezzeh değildir. Mülkiyet kavramı ve mülkiyete konu olabilecek değerler hakkında farklı yaklaşımlar olabilmektedir. Bütün bu farklılıklara rağmen günümüzdeki birçok hukuk sistemi ya Roma Hukuku’nu temel alarak gelişmiştir ya da bir ölçüde onun etkisine maruz kalmıştır.
Yani bütün bu farklılıklara rağmen Roma Hukuku hala ortak bir değer olarak görülebilir. Bu önemine binaen Roma Hukuku’nda mülkiyet ve teminat kavramlarının birbiri ile olan ilişkisinin tahlili bu kavramlar ile ilgili olarak günümüzde karşılaştığımız ve gelecekte karşılaşılması muhtemel sorunların daha iyi anlaşılmasına katkı sağlayacaktır. Bu çalışma da bu amaca istinaden Roma Hukuku ekseninde mülkiyet ve teminat kavramlarını ve bunların birbiri ile olan ilişkisini analiz edecektir.

Abstract
Abstract: The influence of Roman Law on today’s legal systems cannot be denied. The concepts of property and security are not immune from this influence. There are different approaches regarding the concept of property and the values that can be subject to property law.
Despite all these differences, Roman Law can still be seen as a common value because many legal systems have either developed based on Roman Law or have been influenced by it. Due to this importance, the analysis of the relationship between the concepts of property and security in Roman Law will contribute to a better understanding of the problems we face today and the problems that may be encountered in the future regarding these concepts. For this purpose, this study will analyze the concepts of property and security and their relationship with each other in the context of Roman Law.
